Compliance Issues

     To be eligible for federal funds, the University must comply with many federal regulations including those regarding the protection of human subjects, humane treatment of vertebrate animals used in research and teaching, and special handling of biohazardous and radioactive materials. These regulations require review and approval of proposed research plans. OSP coordinates various review committees and activities.

     Compliance issues at Xavier University concern the following:

  • Use of Human Subjects
  • Animal Care and Use
  • Bio-Hazards and Recombinant DNA
  • Radiation Safety

Assurances of Compliance

     Additionally, many Public Laws and Executive Orders require universities to file letters of assurance with different agencies.  Some of these refer specifically to the University's monitoring of research activity (referenced above) and some refer to the activities of the University as a whole. Such laws and regulations include:

  • Drug Free School and Campuses Act
  • Debarment and Suspension
  • Lobbying
  • Misconduct in Science
  • Delinquent Federal Debt
  • Civil Rights Act of 1964
  • Rehabilitation Act of 1973
  • Title IX of the Education Amendments of 1972
  • the Age Discrimination Act of 1975

The Office of Sponsored Programs is responsible for checking your proposal to ensure that any requested information regarding assurances is provided.

Use of Animal Subjects

     As mandated by federal law, the University is in compliance with the Department of Health and Human Services in that all University research involving human subjects will follow procedures designed to safeguard their rights and welfare.  According to University policy, all such research, funded or not, conducted by University personnel or students, or otherwise sponsored by the University, must be reviewed by the University Institutional Review Board (IRB).  Approval must be obtained before any activity begins and the project must be reviewed at least annually for as long as it is active.

Animal Care and Use

     Public Health Service Policy requires grantee institutions to review all research, research training and biological testing involving vertebrae animals.  Accordingly, all such activities must be reviewed by the University's Institutional Animal Care and Use Committee (IACUC).

     This applies to all University activity involving vertebrate animals, including both sponsored research and that which is not sponsored and the teaching use of animals.  Review is required before a project begins and annually throughout the life of a project.

Bio-Hazards and Recombinant DNA

     All university research involving recombinant DNA molecules must adhere to the Department of Health and Human Services Guidelines for Research.  This is required of all research in which recombinant DNA is used, regardless of funding source.

Radiation Safety

     The University will ensure compliance with state and federal regulations and will ensure protection of its employees, students and the public in its use of ionizing radiation and disposal of radioisotopes.
